Title VI Civil Rights Non Discrimination
The City of Fulton is committed to compliance with Title VI of the Civil Rights Act of 1964, and all related regulations, executive orders and directives.
The City of Fulton assures that no person shall on the grounds of race, sex, creed, color, religion, national origin, sexual orientation, gender, age, disability, marital or domestic partner, or English proficiency be excluded from participation in, be denied the benefits of, or be otherwise subjected to discrimination under any program or activity. The City of Fulton further assures every effort will be made to ensure nondiscrimination in all of its programs and activities, whether those programs and activities are federally funded or not. In the event that the City of Fulton distributes federal aid funds to another governmental entity, the City of Fulton will include Title VI language in all written agreements and will monitor for compliance.
Definition of Federal Financial Assistance and Recipients Affected
Federal financial assistance is defined as any Federal dollars that are assigned to the City of Fulton to support any program, activity or service by way of grant, loan or contract, other than a contract of insurance or guaranty.
Programs and Services Covered by Title VI
The City of Fulton’s Title VI Non-discrimination Policy applies to all of the entities programs, activities and services, regardless of funding source. Some sections deal with specific requirements (e.g. FAA, FHWA, FRA and FTA funded programs).
Title VI of the 1964 Civil Rights Act provides that no person in the United States shall, on the grounds of race, color, national origin, or gender be excluded from participation in, be denied the benefits of, or be otherwise subjected to discrimination under any program or activity receiving federal financial assistance (please refer to 23 CFR 200.9 and 49 CFR 21).
The Civil Rights Restoration Act of 1987 broadened the scope of Title VI coverage by expanding the definition of terms "programs or activities" to include all programs or activities of Federal Aid recipients, subrecipients, and contractors, whether such programs and activities are federally assisted or not (Public Law 100-259 [S. 557] March 22, 1988).
Additional Authorities and Citations Include: In addition to Title VI, there are other Nondiscrimination statutes that afford legal protection. These statutes include the following: Section 162 (a) of the Federal-Aid Highway Act of 1973 (23 USC 324) (sex), Age Discrimination Act of 1975 (age), and Section 504 of the Rehabilitation Act of 1973/Americans with Disabilities Act of 1990 (disability) and 42 USC 2000d to 2000d-4; 42 USC 4601 to 4655; 23 USC 109(h); DOT Order 1050.2; EO 12250; EO 12898; 28 CFR 50.3; EO 13166. Taken together, these requirements define an over-arching Title VI/Nondiscrimination Program. It is important to also understand that Title VI and the additional Nondiscrimination requirements are applicable to Federal programs in addition to programs receiving federal financial assistance due to the Civil Rights Restoration Act of 1987.
